The rules of the ranks.

Tuute is designed for entertainment and personal tracking purposes only.

Tuute lets you record fart-related activity, including the date and time, loudness, smell, and associated foods, and view your personal logging history, statistics, and progress.

Tuute is not a medical device, healthcare service, diagnostic tool, or medical provider. Tuute does not provide:

• medical diagnoses;
• medical advice; or
• treatment recommendations.

Statistics, trends, rankings, and food information shown in Tuute should not be interpreted as medical findings and are not a substitute for advice from a qualified healthcare professional.

Tuute relies entirely on information voluntarily entered by users. Tuute does not verify whether an actual fart occurred. Individual entries and leaderboard scores are user-generated and are not scientifically or medically verified.

If you have concerns about your digestive health, symptoms, diet, or any other medical matter, consult a qualified healthcare professional. Do not delay seeking medical care because of information displayed by Tuute.

Tuute is not intended for children under 13.

You must be at least 13 years old to use the Services or create a Tuute account.

If the laws where you live require parental or guardian authorization for a minor to use the Services or enter into these Terms, that authorization must be obtained before use.

If we learn that personal information associated with Tuute belongs to a child under 13, we may delete that information and any associated account as required by law. Parents or guardians may contact ijusttuuted@gmail.com.

You must create a free Tuute account using Sign in with Apple or Sign in with Google to access the app's features. There is no guest mode or anonymous logging.

Account creation does not require payment. Every completed account setup generates a username and automatically enrolls you in the World Leaderboard.

Every free account receives:

• 10 Tuute logs per 24-hour period;
• logging history and statistics;
• food tracking;
• loudness and smell tracking; and
• World Leaderboard participation.

Some features, including the World Leaderboard, require an internet connection.

A Tuute account is free and does not require purchasing a subscription.

You are responsible for maintaining the security of your account and device.

You may not:

• access another person's account without permission;
• sell or transfer your Tuute account;
• create fraudulent accounts;
• use automated systems to create accounts;
• circumvent account restrictions;
• attempt unauthorized access to accounts or systems; or
• impersonate another person or organization.

You agree to notify us at ijusttuuted@gmail.com if you reasonably believe your account has been compromised.

Tuute automatically assigns every account a username, such as:

tuuter8912

The precise format may change over time.

Your username lets you participate in the World Leaderboard without displaying your legal name, and it may appear publicly on the leaderboard.

We may modify, regenerate, suspend, or remove usernames where reasonably necessary for security, fraud prevention, legal compliance, or other legitimate operational reasons.

A Tuute username does not give you ownership rights in that username.

During account setup, you select your country. Your selected country may appear publicly on the World Leaderboard and may be used for:

• World Leaderboard rankings;
• country-specific leaderboards;
• displaying a country identifier or flag; and
• related statistics.

You should select the country that appropriately represents you.

We may modify a selected country where reasonably necessary for security, fraud prevention, or other legitimate operational reasons, including if we reasonably believe it is being used to manipulate leaderboard systems.

Selecting a country does not require Tuute to collect your precise GPS location.

Completing account setup automatically enrolls your account in World Leaderboard participation. You do not need to separately opt in.

Free and paid accounts participate equally in the same World Leaderboard. An active subscription is not required to participate.

Public leaderboard information includes:

• your generated username;
• your selected country;
• your total Tuute count or score;
• your world ranking; and
• your country ranking, if available.

Individual logs, food selections, loudness ratings, smell ratings, email addresses, and subscription details are not publicly displayed.

If you do not want to appear on the World Leaderboard, you may delete your account as described in Section 17.

Tuute's leaderboard is intended to be fun. Users manually enter their own activity, and this information is not independently verified. Ordinary manual entries are permitted.

You may not interfere with the technical integrity of the leaderboard. Prohibited conduct includes:

• using bots or automated logging;
• unauthorized API manipulation or tampering with app traffic;
• exploiting bugs or vulnerabilities;
• modifying the app to falsify activity;
• creating fraudulent accounts; or
• attempting to compromise or directly alter leaderboard systems or data.

We reserve the right to investigate suspicious technical activity and to address fraudulent manipulation of our systems, including by removing entries, adjusting rankings, or excluding, suspending, or terminating accounts.

Leaderboard rankings are provided for entertainment and have no monetary value.

You are responsible for the information you voluntarily enter into Tuute.

Your Tuute logs and account information are associated with your account and may be stored through cloud infrastructure.

Individual logs remain private and are not publicly displayed on leaderboards.

Our collection, storage, and handling of personal information, and your related rights, are described in our Privacy Policy, which is incorporated into these Terms by reference.

Tuute offers two optional subscriptions:

• Monthly Unlimited Logging: $1.99 per month.
• Annual Unlimited Logging: $9.99 per year.

These are intended U.S. prices. Subscriptions provide unlimited Tuute logs while active. All other core functionality remains available to free users. You must be signed in to your Tuute account to access and use subscription functionality.

Subscriptions are intended to be processed through Apple's App Store. By subscribing:

• subscriptions automatically renew unless canceled;
• Apple processes applicable subscription payments;
• charges are billed through your Apple Account;
• you can manage or cancel subscriptions through Apple's subscription settings;
• cancellation generally prevents future renewals; and
• access typically continues through the current paid billing period, subject to Apple's policies.

You can manage subscriptions on your iPhone at:

Settings → your name → Subscriptions → Tuute

Subscription prices may vary by country, currency, tax treatment, and Apple's storefront pricing. The price displayed and accepted at purchase controls the transaction.

Canceling a subscription does not automatically result in a refund. See Section 12.

Prices may change in the future. Any price changes will be handled in accordance with applicable law and Apple's requirements.

Tuute's subscription purchase screen is intended to clearly display:

• the subscription name;
• the price;
• the billing period;
• that the subscription renews automatically;
• the features included;
• cancellation information; and
• links to these Terms of Use and our Privacy Policy.

These disclosures are intended to meet Apple's App Store requirements for auto-renewable subscriptions.

Your purchase is not complete until confirmed by Apple.

Purchases made through Apple's App Store are generally subject to Apple's refund procedures and applicable consumer laws.

You may request eligible refunds through Apple. Suttle AI LLC does not control and does not guarantee whether Apple approves a refund request.

Nothing in these Terms limits any refund or cancellation right that cannot legally be waived.

Free Users

• 10 Tuute logs per 24-hour period;
• personal history and statistics;
• food, loudness, and smell tracking; and
• World Leaderboard participation.

Paid Users

• unlimited Tuute logs;
• everything included for free users; and
• the same World Leaderboard participation.

Payment is not required to create an account or to participate in the World Leaderboard. Paid subscriptions do not provide higher rankings or special leaderboard treatment.

We will not intentionally remove access to a paid entitlement during a period for which you have already paid, except where necessary because of legal requirements, fraud, abuse, technical impossibility, or circumstances otherwise permitted by applicable law.

Tuute does not currently plan to display advertising at launch.

We may introduce advertising in the future. If we do, these Terms and our Privacy Policy may be updated as required.

The following restrictions apply to all users. You may not:

• violate applicable law;
• interfere with Tuute's operation;
• access systems or information without authorization;
• attempt to bypass security protections;
• introduce malware or malicious code;
• reverse engineer Tuute except where applicable law expressly allows it;
• scrape Tuute using automated systems without permission;
• attempt to gain unauthorized access to another user's information;
• exploit vulnerabilities;
• interfere with servers or networks;
• use Tuute for fraud;
• manipulate subscriptions or purchases;
• manipulate leaderboard systems;
• infringe another person's intellectual property rights; or
• use Tuute in a manner that could reasonably damage Tuute or other users.

We may suspend, restrict, or terminate access to accounts or online features where reasonably necessary, including because of:

• violation of these Terms;
• suspected fraud;
• leaderboard manipulation;
• security threats;
• unlawful activity;
• technical abuse; or
• legal or regulatory obligations.

Where reasonable and legally required, we may provide notice before termination. These actions are subject to any consumer rights that cannot be waived.

You may stop using Tuute at any time.

All Tuute users have accounts. You can initiate deletion of your account from within Tuute.

Account deletion removes or de-identifies associated personal information and your leaderboard participation, except where information must or may lawfully be retained for purposes such as fraud prevention, security, legal compliance, transaction records, or dispute resolution.

• Deleting the app does not automatically delete your online account.
• Deleting your account does not automatically cancel an Apple subscription.
• You should manage subscriptions through Apple's subscription settings.

Tuute and its associated software, designs, graphics, interfaces, branding, trademarks, logos, illustrations, text, code, functionality, and other materials are owned by Suttle AI LLC or its licensors and are protected by intellectual property laws.

Except for the limited rights necessary to use the Services, these Terms do not transfer any ownership rights to you.

You may not reproduce, distribute, sell, license, copy, modify, create derivative works from, or commercially exploit Tuute or its content unless permitted by us in writing or by applicable law.

Using Tuute does not give Suttle AI LLC ownership of your personal information.

If you obtain Tuute through Apple's App Store, your license to the mobile application is also governed by Apple's Licensed Application End User License Agreement (Standard EULA), unless a separate custom EULA is provided through the App Store.

Apple's Standard EULA provides a nontransferable license to use the application on Apple products you own or control, subject to Apple's Usage Rules.

These Terms govern your use of Tuute's Services, accounts, leaderboard, subscriptions, website, and other Tuute functionality.

If you voluntarily provide suggestions, ideas, feature requests, bug reports, or other feedback regarding Tuute, you grant Suttle AI LLC permission to use that feedback without restriction or compensation to you.

This does not grant us ownership of your private Tuute logs or personal information.

Tuute may rely on third parties to provide services such as authentication, cloud hosting, databases, and subscription management and payment processing through Apple. Not every category of provider may be in use at any given time.

We are not responsible for independent third-party services outside our control.

Your use of third-party services may also be governed by their own terms.

We work to keep Tuute available, but we do not guarantee uninterrupted or error-free operation.

Tuute may occasionally be unavailable because of:

• maintenance;
• updates;
• technical failures;
• internet outages;
• third-party service failures;
• security incidents; or
• circumstances outside our reasonable control.

We may add, modify, suspend, or discontinue features.

Leaderboard rankings, statistics, historical calculations, and other features may change as Tuute evolves.

You are responsible for retaining any information you consider important.

Where we provide account storage or synchronization, we do not guarantee that every Tuute log or other piece of data will be preserved indefinitely.

Data may be lost because of software errors, device problems, account deletion, service outages, user actions, or other circumstances.

To the extent permitted by law, Suttle AI LLC is not responsible for the loss of data that does not result from our violation of applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUUTE AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

We disclaim warranties of any kind, whether express, implied, or statutory, including warranties of:

• merchantability;
• fitness for a particular purpose;
• non-infringement;
• accuracy;
• reliability;
• availability; and
• uninterrupted operation.

We do not warrant that:

• Tuute will always be available;
• Tuute will be error-free;
• statistics or rankings will always be accurate;
• every log will be preserved;
• the Services will meet every user's expectations; or
• information provided through Tuute is medically or scientifically meaningful.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUTTLE AI LLC, ITS OWNER, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.

To the maximum extent permitted by applicable law, Suttle AI LLC's total aggregate liability arising from or relating to the Services or these Terms will not exceed the greater of:

• (a) the amount you paid for Tuute during the 12 months immediately preceding the event giving rise to the claim; or
• (b) $100 USD.

These limitations do not apply where liability cannot legally be excluded or limited, and they do not prevent you from bringing a claim.

Nothing in these Terms limits liability for fraud, willful misconduct, or other liability that applicable law does not permit us to limit.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Suttle AI LLC and its owner, affiliates, officers, employees, and contractors from claims, liabilities, losses, damages, and reasonable expenses arising from:

• your violation of these Terms;
• your unlawful use of Tuute;
• your infringement of another person's rights; or
• fraudulent or abusive activity associated with your use of Tuute.

This obligation does not apply to the extent a claim results from Suttle AI LLC's own unlawful conduct.

Nothing in these Terms is intended to waive rights that cannot lawfully be waived.

If consumer protection laws in your jurisdiction provide rights or remedies that conflict with these Terms, those mandatory rights remain applicable.

Except where the laws of your jurisdiction require otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights applicable where you live, disputes that are not otherwise resolved shall be brought in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

We may update these Terms as Tuute evolves.

When we update them, we will change the "Last Updated" date above.

If changes materially affect your rights or obligations, we may provide additional notice through Tuute, our website, or another reasonable method.

Where required by law, we will request your consent before materially changed Terms become binding.

Continuing to use Tuute after updated Terms become effective constitutes acceptance where permitted by law.

If any provision of these Terms is found unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our permission.

Suttle AI LLC may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, financing, or transfer of the Tuute business, subject to applicable law.

These Terms, together with the Tuute Privacy Policy and any purchase terms presented to you, constitute the agreement between you and Suttle AI LLC concerning the Services.

For applications obtained through the Apple App Store, Apple's applicable terms and Standard EULA may also apply.
